Your telegram No. 18176 of October 17th. Draft China treaty.

2. We agree that course (a) paragraph No. 1 of telegram under reference is preferable and should be adopted. TO avoid constitutional complications in regard to Indian' Jtates it will be necessary for Secretary of State to sign on India's behalf.

3. We suggest point made in paragraph No. 2 of telegram under reference might be covered by having it clearly understood that rights of, travel residence and commerce must be subject to any general' or special law for the time being in force. This would meet the difficulties in regard not only to tribal territory but also to war prohibited areas without the need for specification. We should have

much preferred in the light of our experience with the Chinese to have had this cleared by exchange of letters but with reference to your telegram No. 18282) are prepared to waive this if H.M. Government think it necessary and are satisfied that informal discussion will leave no possibility of misunderstanding leading to friction later.

4 a we agree with suggestion made in paragraph No. 3 of telegram under reference in regard to Consular Officer,
